EEOC Extends EEO-1 Deadline for 2019/2020 Data

Certain employers are required to file their Equal Employment Opportunity (EEO-1) report on an annual basis.  This is mandatory for eligible employers as per section 709(c) of Title VII of the Civil Rights Act of 1964, as amended, 42 U.S.C. § 2000e-8(c), and 29 CFR 1602.7-.14 and 41 CFR 60-1.7(a).  Recognizing the continuing impact of the Coronavirus pandemic, the deadline to submit and certify the 2019/2020 EEO-1 Component 1 data has been extended.  The new filing deadline is Monday, October 25, 2021.  According to the US Equal Employment Opportunity Commission (EEOC), this extension will be the last one provided. Thus, all eligible filers must submit their data by October 25th.  

 

FAQ’S ABOUT EEO-1 REPORTING REQUIREMENTS

 

WHAT IS AN EEO-1 REPORT?

The EEO-1 Component 1 Report is an annual survey that requires certain employers to submit data to the EEOC summarizing their employee demographics (i.e., race/ethnicity and sex/gender) and all job categories. The EEOC uses this information to support civil rights enforcement and to analyze employment patterns, such as the representation of women and minorities within companies, industries, or regions.

 

IS MY COMPANY REQUIRED TO FILE AN EEO-1 REPORT?

Maybe!  The EEO-1 Component 1 Report data must be collected annually if:

You have 100 or more employees; or

You have less than 100 employees but are owned, affiliated with, or controlled by a company with more than 100 employees overall; or

You are categorized as a federal government prime contractor or first-tier subcontractor with 50 or more employees AND have a prime contract, or first-tier subcontract amounting to $50,000 or more; or

You have 50 or more employees AND you act as an issuing and paying agent for US Savings Bonds OR serve as a depository of government funds. 

 

WHAT IF MY COMPANY HAS MULTIPLE BUSINESS LOCATIONS?

Single-establishment employers have much smaller reports to submit each year. Since they’re only reporting for one location, they’re only required to file a single Type-1 data report.  On the other hand, multi-establishment employers (those who conduct business at two or more physical addresses) must submit significantly more information containing various forms of reports for every location they have.  Except for Company headquarters, all locations, even if they only have one employee, must be reported.  Please be reminded that all full-time and part-time employees must be included, and don’t forget to count your remote employees!

 

What Actions Do I Need to Take?

If you’re submitting data for the first time, the EEOC requires you to register and create a user account within their EEO-1 Component 1 Online Filing System.  After the registration process is complete, your company’s Human Resource (HR) representative, or designee, can enter the data directly into the secure web portal or they can upload data files.  For additional information, you can review the EEOC’s home page and website.
